2. Acceptance of the general conditions of sale

By contracting a service offered by BORMES PLONGEE, the customer accepts these general conditions of sale and declares to have taken cognizance of the contraindications to scuba diving and to be suitable for its practice. He is also able to present a medical certificate of no contraindication to the practice of scuba diving for less than one year (this does not apply to discovery and snorkeling).
In addition, a minor client must also be in possession of a parental authorization allowing him to perform scuba diving or snorkeling with Bormes Plongée.

All practitioners undertake to respect the guidelines and regulations in force, the sports code (Art. A. 322-71. To Art. A. 322-101) as well as the charter of the Port National Park. Cros.

Bormes Plongée reserves the right to refuse a service to a client whose state of physical or psychological health would be in contraindication with the practice of the activity.

3. SERVICE

Equipment rental :

All diving equipment is available for hire: Wetsuit, shorty, regulator, stabilizing vest, lamp, dive computer, diving bottle, rebreather at the price indicated on the website and displayed on site.

In the event of loss or deterioration, the diver undertakes to replace the equipment concerned identically or to operate his insurance in order to replace the object in question. By subscribing to an equipment rental, the customer agrees to accept these conditions.

Exploration:

Boat transport and air inflation are included in the price of the dive. Nitrox inflation is extra.

Diving package:

Bormes Plongée offers diving packages benefiting from decreasing prices for explorations. The validity of these individual packages is two years after the date of purchase. Beyond the validity date, dives not consumed cannot be reimbursed.

Nice present :

Validity 1 year after the date of issue. Non-refundable but exchangeable for another service of equivalent value.

Discovery and Training:

The discovery packages and Basic Diver SSI, Scuba Diver SSI, Open Water SSI and Level 1 packages include the loan of diving equipment specific to the activity and the dive log (except Basic Diver)

The price of higher education (specialty courses, level 2, level 3, level 4) does not include the rental of equipment.

The price of French schools FFESSM / ANMP training includes:

• The scuba tank inflated with air

• Practical courses at sea

• certification fees

And does not include:

• The license in case of FFESSM certification choice.

• The training manual

• Theoretical training which must be prepared beforehand for the exam

The price of SSI international school training courses include:

• The scuba tank inflated with air

• Practical courses at sea

• boat transport

• Certification fees in the form of a digital card

• The digital dive log

And does not include:

• Theoretical courses called Digital Kit to be purchased beforehand

• Certification fees in the form of a plastic card (limitation of the environmental impact)

Full day:

As part of the day trips (2 dives) with a stop in Cavalaire or Port Cros, a supplement of 8 euros per diver will be requested.

Optional catering options are available and the possibility of coming with your own picnic.

The second dive cannot be canceled on site and will remain due unless canceled by us.

Snorkeling:

The snorkeling service is available for minors from 10 years old provided they are accompanied by an adult (in the water).

This service does not include supervision in the water by an instructor.

The equipment necessary for the activity is loaned (wetsuit, mask, fins, snorkel).

Surface buoys will be made available on request.

A surface surveillance will be carried out by the pilot of the boat who will determine an area of ​​movement.

4. PRICES

All prices displayed at the dive center and on the website are expressed in euros and include all taxes (TTC).

The applicable and invoiced rate is that in force on the day of the reservation request by the customer.

The company reserves the right to modify its prices at any time of the year.

5. RESERVATION and TERMS OF PAYMENT

The customer's reservation will be definitively recorded after payment of a deposit of 30% of the total amount within 8 days of the date of reservation by email or telephone.

The balance must be paid to the diving center at the end of the service.

6. CANCELLATION, POSTPONEMENT, DIVE INTERRUPTION

From the Client / Diver

Withdrawal period: In accordance with article L. 121-20 of the Consumer Code, “the consumer has a period of seven clear days to exercise his right of withdrawal without having to justify reasons or pay penalties. The period mentioned in the previous paragraph runs from the receipt for the goods or from the acceptance of the offer for the provision of services ”. The right of withdrawal can be exercised by contacting the Company by email: bormesplongee@gmail.com. In the event of exercise of the right of withdrawal within the aforementioned period, only the price of the services purchased will be refunded.

Cancellation: Bormes Plongée reserves the right to invoice the reserved activities in the event of cancellation without medical proof or reported less than 24 hours before the exploration dive, 7 days for standard training and 30 days for group bookings (as mentioned in the specific group contract)

Any delay by the customer may not give rise to a delay in the service if the customer does not show up at the set time, this situation will be considered as a last minute cancellation.

Any activity started will not give rise to any refund, if the cancellation is due to the customer.

Regarding training and courses reserved for defined periods, if the client has started the training and is unable for any reason whatsoever to continue the training, it is up to BORMES PLONGEE to decide whether the client is liable for the total amount of the service or if the services (courses and dives) not consumed can be postponed to a later date.

From BORMES PLONGEE

A service can be canceled for meteorological or technical reasons without compensation due to the customer.

In the event of a deposit or payment of the full amount, BORMES PLONGEE will propose the postponement of the service within the limit of available places or the total reimbursement of paid services not consumed.

7. INSURANCE

Civil liability: By practicing with BORMES PLONGEE, you are covered by our professional RC insurance. You must be covered for civil liability during your activities within the school. You also have the possibility to take out additional personal insurance through us (article A321-4 of the sports code)

Theft / damage to personal effects: The diving school is in no way responsible for objects left or entrusted to the diving center. The center cannot be held responsible for the theft or loss of personal property, whether in the center or during a service.

8. ENCLOSURE AUTONOMY AND SEVERABILITY

In the event that one of the clauses of these Conditions would become inapplicable or would be null and void as a result of a change in legislation, regulations or by the effect of a court decision, this shall not in any case affect the validity and compliance with the other provisions of these Conditions which will all remain in force.

9. APPLICABLE LAW

These GTC are exclusively governed by French law. In the event of a dispute, the Parties will endeavor to amicably resolve their dispute and failing this, competence of attribution is given to the competent Courts within the jurisdiction of the registered office of Bormes Plongée or the Court of Toulon.
